1. PREAMBLE


The purpose of these general conditions (hereinafter the “General Conditions”) is to define the terms and conditions under which “LES BOUCLES DE MEUSE” allows its customers (hereinafter the “Customer(s)”) to benefit from all the services, in particular reservations, available on this Site and described in more detail below (hereinafter together the “Services”).

Prior to any reservation of a Service on the Site, the Customer declares that he is acting for personal purposes which do not fall within the scope of his commercial, industrial, artisanal, liberal or agricultural activity and that he has full legal capacity. allowing you to commit to these General Conditions

The Customer is invited to carefully read these General Conditions, prior acceptance of which is mandatory for the reservation of any Service offered on the Site. All Customers are advised to save and print these General Conditions using the standard functionalities of their browser and computer.

“LES BOUCLES DE MEUSE” reserves the right to modify or supplement, at any time, all or part of these General Conditions. In this case, the new version of the General Conditions will be available on the Site with its effective date. Customers are advised to regularly consult the General Conditions to be aware of any possible modifications. In any event, the Client will only be bound by the version of the General Conditions in force at the time the Client makes the reservation for their Service.

The Customer is solely responsible for paying, where applicable, for all technical means giving him access to the Site.


2. DESCRIPTION OF SERVICES


2.1 SERVICES

“LES BOUCLES DE MEUSE” offers on its Site reservation services for hotel rooms or other types of accommodation (“Accommodation Services”) (2.1.1) and services complementary to said Services (“Additional Services” ) (2.1.2).

The Hosting Services and the Additional Services are hereinafter together referred to as the “Services”.

2.1.1 HOSTING SERVICES

The Site allows the reservation of rooms in the LES BOUCLES DE MEUSE hotel (hereinafter referred to as “the hotel”).

The essential characteristics, availability dates, price, options offered, payment conditions and special conditions of sale applicable to the selected rate (guarantee policies, cancellation conditions, check-in time, etc.) of the The hotel offered are presented during the reservation process as described in article 3 below.

The special conditions of sale applicable to the selected rate are available on the Site (hereinafter the “Special Conditions”) and are brought to the attention of the Customer before any reservation on the Site. Thus, for example, check-in and check-out times, the guarantee policy, the cancellation period, access to WiFi, the specific conditions applicable to children, the admissibility of animals as long as they are kept on a leash or in a cage in the common areas of the establishment.


2.1.2 ADDITIONAL SERVICES

The Site also allows the reservation of Additional Services, such as breakfast.

The Complementary Services also cover travel services within the meaning of article 3.1 of Directive (EU) 2015/2302 of November 25, 2015 relating to package travel and related travel services, likely to form with the Accommodation Services either a “related travel service” or a “tourist package” according to the criteria specified by the said Directive. This information is communicated to the Customer prior to booking these services in the Special Conditions specific to each offer.

2.2 PARTNER SERVICES

“LES BOUCLES DE MEUSE” enters into partnership and distribution contracts with third party websites (“Partners”) in order to allow the Customer to search, select and reserve rooms at the “LES BOUCLES DE MEUSE” hotel on the partner’s website (hereinafter the “Partner Services”).

The conditions of sale applicable to these Partner Services are available on the Partner's website.


3. BOOKING PATH


The Customer chooses any Service presented on the Site or those of its partners by following the path provided for this purpose.

3.1 RESERVATION OF SERVICES

Reservations for the Services are made by the Customer on the Site.

The reservation process varies depending on the navigation and the Customer's request; it includes the following steps:

- Step 1: providing search criteria for availability, where applicable, of one or more Additional Services;

- Step 2: the results and the selection of availability and, where applicable, one or more Complementary Service(s);

- Step 3: details and characteristics of the selected Service(s), particularly if it is a Hosting Service: the characteristics of the Accommodation (category, TV, equipment, etc.) .), the duration of the stay, the options offered (example: breakfast, wifi access, etc.), the total price of the reservation including details of applicable taxes, and all applicable Special Conditions (guarantee policies, conditions cancellation policy, check-in time, etc.);

- Step 4: summary of the reservation of the Service(s) with: reminder of the main characteristics (duration of stay, characteristics of the Accommodation Service and/or Additional Service(s), amount including tax with details of applicable taxes) and, the provision by the Customer of their contact details by filling in all the mandatory fields (indicated by an asterisk);

- Step 5: finalizing the reservation of the Service(s) by the Customer with: providing the details of their means of payment, either in the event of prepayment of the reservation, in full, before the stay, or in the event of request for a reservation guarantee for Accommodation Services and: consultation and acceptance of the General Conditions and the Special Conditions relating to the reservation before its validation by the Client;

- Step 6: taking into account the reservation of the Service(s) by “LES BOUCLES DE MEUSE”;

- Step 7: an email confirming the reservation of the Service(s) is sent to the Customer summarizing the Service(s) reserved, the price(s), the Special Conditions accepted by the Customer, the date of the reservation made, information relating to after-sales service and access to the General Conditions as well as the address where the Customer can submit complaints.

Any reservation is deemed to have been made as soon as the Customer clicks on the “finalize your reservation” page in the case of a prepaid reservation, on the “Pay” button or in the case of a reservation to be paid within the Establishment, on the “Confirm” button.

The Customer may make a reservation for Services in the name of one or more other person(s), subject to available rooms.


3.2 RESERVATION OF PARTNER SERVICES

Reservations made by the Customer via the Partner Services are made via the website and mobile services of each Partner. The reservation is made directly between the Customer and the Partners, following the steps on the Partners' website and mobile services.


4.1 PRICE

The prices relating to the reservation of the Services are indicated before, during and after the reservation.

For Accommodation Services, the prices indicated are per room for the number of people and the date selected

When confirming the reservation of a Service, the total price is indicated to the Customer in the amount including tax in the commercial currency of the Establishment (euros) and is only valid for the duration indicated on the Site.

Unless otherwise stated on the Site, options (for example, breakfast, half board, full board etc.) which are not offered at the time of booking the Service are not included in the price.

The tourist tax, presented during the Service reservation process, must be paid directly on site to the Establishment, except in the case of online prepayment before the stay where this amount can be included

The prices take into account the VAT applicable on the day of the reservation and any change in the rate applicable to the VAT will be automatically reflected in the price indicated on the invoice date.

Any modification or introduction of new legal or regulatory taxes imposed by the competent authorities will be automatically reflected in the price indicated on the invoice date.

Finally, certain promotional offers are only available on the Site and are sold exclusively on the internet and in no case at the Establishment's reception.


4.2 BEST PRICE GUARANTEED

If the Customer finds a cheaper price elsewhere within 24 hours of booking on the Site and at the latest 48 hours before the scheduled arrival date at the Establishment, “LES BOUCLES DE MEUSE” undertakes to align itself with the lowest price. The conditions of eligibility for this offer and the procedure to follow to benefit from it are described in the “Best Price Guaranteed” general conditions.


4.3 PAYMENT

4.3.1 General provisions

The Customer communicates his payment data either to prepay the reservation before the stay, or as a guarantee of the reservation, or to pay for his stay at check-out, by indicating directly, in the area provided for this purpose (secure entry by SSL encryption) when it is a bank card, the bank card number, as well as its validity date (it is specified that the bank card used must be valid at the time of the stay) and the visual cryptogram via the AmenitzPay by Stripe payment platform to secure online payments by bank card. The Customer's payment card is subject to a validity examination by these partners and may be refused for several reasons: stolen or blocked card, limit reached, entry error, etc. In the event of a problem, the Customer must contact their bank on the one hand, and the Establishment or any other entity, on the other hand, to confirm their reservation of the Service and their method of payment.

The online payment methods (cards, wallet, etc.) available are mentioned on the payment page of the Site. In the event of payment on site, the Establishment may accept means of payment different from that communicated at the time of booking, the Customer must then present to the Establishment the bank card which allowed them to guarantee the reservation or to carry out the prepayment. The Establishment may also ask him to present an identity document for the purposes of preventing bank card fraud.

An invoice will be sent in electronic format to the email address provided by the Customer when booking at the customer's request; if the Customer wishes to receive an invoice in paper format, he must expressly request this.


4.3.2 Prepayment

Prepayment means any payment made at the time of booking by the Customer.

At the time of prepayment, the amount that is debited when booking the Service includes either the total amount indicated at the time of booking (including all applicable taxes) and, where applicable, the price of the options selected by the Customer, as described in article 4.1 above, or a percentage of this total amount.


4.3.3 Bank guarantee

The guarantee of the reservation by the bank card means taking the Customer's payment details during the reservation. The Customer's bank card is not debited and payment for the stay is made directly to the Establishment on the day of arrival or departure, unless the Customer does not show up at the Establishment and he has not previously canceled his reservation according to the cancellation conditions of the reserved rate.


4.3.5 No-show of the Client

If the Client does not show up on the first day of booking a Accommodation Service, the Client's reservation will be canceled in full and the Establishment will put the reserved Accommodation Services back up for sale:

- In the event that the reservation subject to a no-show is a non-cancelable and/or non-exchangeable and/or non-refundable reservation, the Establishment will retain, as a deposit within the meaning of articles 1590 of the Code civil and L 214-1 of the Consumer Code in their current versions, the totality of the sums paid by the Customer when booking.

- In the event that the reservation subject to a no-show is a cancelable and/or exchangeable and/or refundable reservation guaranteed by credit card, the Establishment will debit the credit card provided at the time of reservation for the amount including tax of the first night booked. Additional nights (beyond the first night) will be canceled without charge. The Client is informed that in such a case, the Establishment will put its rooms back up for sale. The Customer will not be entitled to any reimbursement or any compensation.

At the time of prepayment of a non-cancelable / non-exchangeable / non-refundable reservation, the amount of deposit that is debited includes the total amount indicated during the reservation and, where applicable, the price of the options selected by the Customer, such as as described in article 4.1 above.


5. CANCELLATION OR MODIFICATION OF THE RESERVATION OF A SERVICE


For Accommodation Services (room reservations), the Customer is reminded that he does not have the right of withdrawal provided for in article L. 221-18 of the Consumer Code, in accordance with article L. 221-28 paragraph 12 of the Consumer Code which excludes this right for contracts relating to accommodation services which must be provided on a specific date or period.

For each Service reservation, the Special Conditions specify the terms of cancellation and/or modification of the reservation.

Reservations with prepayment cannot be subject to any modification and/or cancellation. Deposits (amounts paid in advance) will not be refunded. In this case, it is mentioned in the Special Conditions.

When the Special Conditions allow it:

• cancellation of the reservation of a Service can be made directly by email by writing to contact@lesbouclesdemeuse.fr, or by telephone at 03.24.35.79.47; any cancellation or modification to be valid must be confirmed by email from the establishment, the Customer undertakes to verify receipt thereof.

• modification of the reservation of a Service can be made directly with the Establishment, by telephone or by e-mail.

In the event of interruption of a Service due to the Customer, the entire agreed price will be collected. In the case of reservations with prepayment before the stay, no refund will be granted.

In the presence of an Accommodation Service, unless otherwise expressly stipulated in the Special Conditions, the Customer must leave the room of the Establishment before 10:00 a.m. on the day the reservation ends. Otherwise, he will be billed for an additional night.

For reservations made by a partner, the customer must follow the steps indicated by the partner.


6. COMMITMENTS AND RESPONSIBILITY OF THE CUSTOMER


The Customer is solely responsible for his choice of Services on the Site and their suitability to his needs, such that “LES BOUCLES DE MEUSE” cannot be held responsible in this regard.

The Customer is also solely responsible for the information communicated when creating his account and/or any reservation of a Service. “LES BOUCLES DE MEUSE” cannot be held responsible in the event of erroneous or fraudulent information communicated by the Customer. In addition, only the Customer is responsible for the use of his account and any reservation made, both in his personal name and on behalf of third parties, including minors, unless fraudulent use not resulting from any fault can be demonstrated. , nor negligence on his part. In this regard, “LES BOUCLES DE MEUSE” must be immediately notified of any misappropriation or fraudulent use of its email address to customer service whose contact details are specified in article 9.

The Customer undertakes to use the Site and the Services offered there in compliance with the applicable regulations and these General Conditions. In the event of failure by the Customer to fulfill his obligations under these General Conditions, the latter is responsible for the damage caused by him to “LES BOUCLES DE MEUSE” or to third parties. As such, the Client undertakes to guarantee “LES BOUCLES DE MEUSE” against all claims, actions or recourse of any nature which could result therefrom and to indemnify it for any damages, costs or compensation whatsoever relating thereto.

The Customer, in particular, undertakes, by making a definitive reservation for a Service, to pay the price and to respect the Special Conditions relating thereto. Indeed :

- Any reservation or payment which is irregular, inoperative, incomplete or fraudulent for a reason attributable to the Client will result in the cancellation of the reservation of the Service at the Client's expense, without prejudice to any action that “LES BOUCLES DE MEUSE” may take against the Client. against the latter

- The Client must not invite into the Establishment a person whose behavior is likely to harm the Establishment.

- The Customer must not bring drinks or food from outside sources into the Establishment (rooms and common areas), unless the Establishment has clearly authorized it in advance.

- The Client must not smoke in the common rooms of the Establishment, and smoking is prohibited in the rooms.

- The Client must not disrupt the operation of the Establishment and must not compromise the security of the Establishment or the people there.

- More broadly, any behavior contrary to good morals and public order within the Establishment as well as non-compliance with the Internal Regulations of the Establishment, will lead to the director of the Establishment and/or any other service provider Service to ask the Customer to leave the premises without any compensation and/or without any reimbursement if payment has already been made. In the event that no payment has yet been made, the Customer must pay the price of the Services consumed before leaving the premises.

- Minors can only stay in an Establishment accompanied by an adult and provided with personal identification. If the accompanying person is an adult other than the parents, he or she must have parental authorization from the child's parents. The Establishment may request these elements.

- The Client also undertakes to ensure that the computer resources made available to it by the Establishment (in particular the WiFi network) are not used in any way for the purposes of reproduction, representation, provision or communication to the public works or objects protected by copyright or related rights, such as texts, images, photographs, musical works, audiovisual works, software and video games, without the authorization of the holders of the rights provided for in Books I and II of the Intellectual Property Code when this authorization is required. The Client is also required to comply with the security policy of the Establishment's internet access provider, including the rules for using the security means implemented with the aim of preventing the illicit use of resources. information technology and to refrain from any act detrimental to the effectiveness of these means.

The Client is responsible for all damage caused by him and/or his guests within the Establishment and bears all costs caused by this damage and/or by non-compliance with the aforementioned rules. “LES BOUCLES DE MEUSE” reserves the right to intervene if necessary and take any appropriate action against the Client.


7. COMMITMENTS AND RESPONSIBILITY OF “LES BOUCLES DE MEUSE”


“LES BOUCLES DE MEUSE” undertakes, within the framework of an obligation of means, to provide access to the Site and the Services offered in compliance with the General Conditions and to act with diligence and competence and to make every effort, in a reasonable limit, in order to remedy any malfunction brought to its attention.

“LES BOUCLES DE MEUSE” may, however, find itself obliged to temporarily suspend the Site without notice, in particular for technical maintenance reasons, without this entailing its liability.

The Customer acknowledges and accepts that “LES BOUCLES DE MEUSE” cannot be held responsible for any inconveniences or damages linked to the use of the Internet network, including, without this list being exhaustive:

- the improper transmission and/or reception of any data and/or information on the Internet;

- the failure of any reception equipment or communication lines;

- any malfunction of the Internet network preventing the proper functioning of the Site and/or the reservation of Services.

The Site may refer to hypertext links of other websites published and managed by third parties for which “LES BOUCLES DE MEUSE” disclaims all responsibility for the content of these websites and the services offered there. In this regard, it is specified that the partners are responsible for promoting the offers published on their own websites. The decision to consult third-party websites is therefore the full responsibility of the Customer.

To facilitate the processing of complaints, you are advised to send us complaints relating to non-performance or poor performance of the Services in writing within eight (8) days after the date of completion of the Service.

In his relations with our establishment, the Customer undertakes to remain courteous and not to make derogatory remarks regarding our establishment or its employees or collaborators, in compliance with the rules of common sense and politeness. . Les Boucles de Meuse reserves the right to take any appropriate measure against the Customer in the event of harmful or reprehensible behavior (in particular unwelcome, malicious or insulting) with regard in particular to our establishment, or its employees or collaborators. .
